The Court of Appeal denies Apple’s offer to stop the application store order in a dispute for years against the creator ‘Fortnite’

Apple has failed to persuade a US Appeal Court to stop the main parts of the order of a federal judge that requires the iPhone manufacturer to open his profitable app store for more competition immediately.

The 9th Court of Appeal of the US District on Wednesday dismissed Apple’s request to set the provisions as the technology company appeals to the judge’s order, which came to a long antitrust lawsuit filed by “Fortnite” Maker Epic Games.

US District Judge Yvonne Gonzalez Rogers in April found Apple in contempt of a previous order of the order she issued in the Epic Games case.

Apple in a statement said that he was “disappointed by the decision not to stay the order of the District Court, and we will continue to argue our case during the complaints process.”

The judge on April 30 ordered Apple to complete some practices that she said were created to bypass the order, including a new 27% Apple fee imposed on app developers when its customers complete an out -App Store app.

The court also stopped Apple from restricting when developers establish links to make purchases outside an application.

The founder and chief executive Tim Sweeney said in a post on X following the decision of the Court of Appeal that “Apple’s long national Nightmare has ended.”

In his emergency appeal, Apple said the ruling blocked the company from “exercising control over the essential aspects of its business operations” and forced him to provide free access to its services.

Apple has faced an “increase in genuine competition” after the Gonzalez Rogers issued its order in April after developers updated applications with “better payment methods, better deals and better consumer choices,” Epic said.

Apple mostly won the issue, but Gonzalez Rogers in 2021 said Apple should allow developers to more easily direct consumers into potentially cheaper non-apps.

Apple opposed that court order to hold a billion -dollar income flow, Gonzalez Rogers wrote in April.

She also said that Apple had deceived the court about her efforts to comply with her order and referred to the company and one of her leaders to federal prosecutors for a possible investigation of criminal contempt.
